Likewise, the Age Discrimination in Employment Act (ADEA) prohibits discrimination in employment against workers age 40 or older by making it unlawful for an employer to fail or refuse to hire, or to discharge any individual. The ADEA can be enforced through the Equal Employment Opportunity Commission (EEOC) as well as by a private action, but a charge with the EEOC must be filed within 180 days of the unlawful practice or action.
